The Premier League have confirmed Everton were wrongly denied a second penalty this season.

David Moyes’ side were previously on the wrong end of an incorrect call in their December defeat to Arsenal for William Saliba’s foul on Thierno Barry.

But the Blues suffered a fresh injustice during last month’s 2-1 reversal at West Ham, where Barry was again at the heart of a controversial call.

The forward found himself impeded by Mateus Fernandes at the London Stadium before the midfielder openly swatted the ball away with his hand.

Referee Stuart Attwell waved away protests and was backed up by Michael Salisbury on VAR duty, who deemed the handball contact to be accidental.

However the Premier League’s Key Match Incidents panel has vindicated Everton’s frustrations by agreeing both referee and VAR had made an error.

A vote of 4:1 confirmed that Fernandes’ action was a ‘non-footballing action and a handball offence, therefore, a penalty should have been awarded’.

Everton CEO Angus Kinnear raised concerns around inconsistent officiating to Professional Game Match Officials Limited after the defeat in the capital.

Moyes later slammed the refereeing body’s response as ‘rubbish’ and insisted, ‘“They don’t speak particularly well to us when we hear from them.”
