A takeaway opening in Smithdown Road has been warned over its operating hours.
Nabzy’s will launch its ninth Liverpool branch and 21st across the UK in the popular student area after being approved by council planners on Tuesday (October 27).
However the popular fried chicken and pizza brand, which was founded in the city, is not permitted to stay open until 3am daily after planning chiefs raised an objection.
Town Hall officials pointed out that the site that Nabzy’s will occupy had already received permission to operate as a takeaway and cafe no later than 11pm.
The ruling, which was granted to the premises in 2011, was to ‘ensure that nearby occupiers are not adversely affected by the development’ in the residential area.
The council’s objection added: “Opening times beyond this would lead to detrimental impacts and public nuisance to nearby occupiers and any application to use the premises opening until 3am would be refused for similar reasons.
“If the terminal hours were reduced to 11.30pm, the Local Planning Authority would remove the objection.”
Nabzy’s founder Nabeel Tabarik admitted to the council’s planning committee that he ‘could have done more research’ before applying for a 3am closure licence.
Councillors approved the fast food chain’s application but advised Mr Tabarik to amend the planning permission urgently to reflect the established operating hours.
He was also cautioned that any breaches of the 11pm closing time could see him brought before the courts for failing to adhere to the ruling.
