Ian Brady discharged from Liverpool NHS hospital

Moors Murderer Ian Brady has been discharged from the NHS hospital in Liverpool where he was being treated after he collapsed and fell.

Brady, 74, was taken under police escort from University Hospital Aintree back to Ashworth Hospital where he is detained under the Mental Health Act.

His discharge has given rise to speculation that he may be well enough to appear before a Mental Health Review Tribunal on Monday 9th July.

He was taken to University Hospital Aintree at Fazakerley on Monday after suffering "a seizure" on a ward at top security Ashworth Hospital near Maghull.

It has also emerged that Brady suffered two fractured vertebrae in the fall at Ashworth Hospital.

Throughout his stay at the University Hospital Aintree he was kept under guard in a private room with two staff from Ashworth keeping watch along with officers from Merseyside Police

Glasgow-born Brady was jailed in 1966 for murdering three children in Manchester.

He has been fed through a nasal gastric tube since he began refusing to eat on hunger strike in September 1999, declaring that he intended to starve himself to death.

Brady is detained under the Mental Health Act and took his case to a high court judge who ruled that he was incapable of taking a sane decision to end his own life.

Since then Brady has fought a protracted legal battle to have his case considered before a Mental Health Review Tribunal, in public, with the press present and able to report proceedings.

He won that battle late last year and the Tribunal has been scheduled to meet next Monday at Ashworth, with the proceedings relayed, via video link, to the Manchester Justice Centre.

Brady was taken out of Aintree Hospital in a blue Volkswagen van with police cars and motorbike outriders providing an escort.

He left via a rear loading bay near the hospital's mortuary building.

He was admitted from the secure psychiatric Ashworth Hospital in Maghull, Liverpool on Monday after suffering a seizure.

Brady's mental health advocate Jackie Powell confirmed that Brady was back at Ashworth Hospital.

Jackie Powell said: "Ian Brady has left Aintree Hospital and has been taken back to Ashworth Hospital under police escort.

"I have been informed that he suffered two fractured vertebrae in the fall on Monday, but was considered well enough to be discharged from Aintree.

"I am due to see him tomorrow and expect to learn more about his condition.

"Whether he will be able to appear before the Mental Health Review Tribunal will be a decision for him to take, in light of whether he feels well enough to do so."

She said his object in applying to the Mental Health Review Tribunal for an order that he should be discharged from the High Security Ashworth Hospital and returned to a prison.

In particular she said that Brady stressed that he does not want to go to a "Scottish prison' and has never expressed any similar desire.

Jackie Powell said: "Ian has never said that he wishes to return to a Scottish Prison.

"He wants the tribunal declare that he is no longer suffering from mental illness.

"Once that declaration is made, it follows that he would be returned to the prison estate, on the grounds that he should no longer be detained under the Mental Health Act."

Ms Powell said she would have no further details about Brady's physical condition until Thursday.

She added: "I'm scheduled to visit him tomorrow and I will get more details directly from about the state of his health.

"I'm sure that, if at all possible, he will want to go ahead with the tribunal."

A Mersey Care NHS Trust spokeswoman confirmed that Brady had been returned to Ashworth Hospital.

The spokeswoman said: "Ian Brady who has been treated at a general hospital following becoming acutely physically unwell on Monday has now returned to Ashworth Hospital.

"He underwent a series of tests and was kept in for observation but has now recovered enough to return to Ashworth Hospital, the high secure hospital where he has been for the last 27 years.

"Ian Brady, 74, remains physically unwell and will be treated by Ashworth Hospital's own physical health care team in conjunction with any expert input required from consultants at the general hospital.

"Ian Brady is due to have a public mental health review tribunal starting on Monday (9 July 2012)."
